Rail line seeks to force Maryland to accept 1.5 million mortgage pay
The Northern Central Railway, by Bernard Carter and John J. Donaldson, filed eight bills in Baltimore Circuit Court against State Comptroller Hering, State Treasurer Vandiver, Governor Smith, and Attorney General Rayner. It seeks a court ruling that Maryland must accept 1.5 million dollars offered as payment on the mortgage of the railway system, an offer the state previously rejected. The suit cites the 1854 act and 1851 charter, argues the tender extinguishes the debt, and asks for an injunction preventing payment sales or transfer of the mortgage. no order was issued.
