Maryland ad ban on drug names ruled unconstitutional
Attorney General Francis B Burch concludes the Maryland criminal prohibition on advertising controlled substances by trade or generic names is unconstitutional under the First Amendment. He cites Virginia Board of Pharmacy v Virginia Citizens Consumer Council and Maryland Board of Pharmacy v Sav-a-Lot, urging state regulation should rely on professional supervision rather than bans.
