New legal challenge halts Whittier PND project by retirees
A retired circuit court judge Samuel W Barrick and retired dentist William H Thomas Jr filed a suit this week to overturn the Frederick City approval of the Whittier Planned Neighborhood Development along Rocky Springs Road. They allege inadequate sewer and streets and claim the plan would devalue land and spoil views. The case cites private talks between developer Marvin Ausherman and city leaders and seeks reversal of the July 10 1989 site plan approval. No hearing date set.
