Decree in Lilly Case Over Audit of Home Sale

Judge Worthington issued an opinion in the Lilly case ruling objections to the auditor's report on the sale of Samuel L. Lily’s East Second Street home. The Frederick Building Association mortgageed the property. Zimmerman's later mortgage led to sale for 4504. The auditor allowed water rent, loan amounts, interest, and a bonus, plus fines and interest to audit date. The court disallowed most of these, noting water rent limited to six months, the bonus non recoverable in a forced sale, and dower claims denied until the husband’s death. The decision raises key legal questions and is noted as significant by Frederick attorneys.
