Demurrers Sustained in Potomac Gun Battle Suit
Associate Judge Patrick Mr. Schnauffer this morning sustained demurrers filed by the Maryland Game and Inland Fish Commission and Game Wardens Benjamin F. Phebus and Durward W. Kettells in a $25,000 damage suit filed by Chapman Shores of Virginia. The action, arising from a Potomac river gun battle last year in which Shores was wounded and later lost a leg, is extinguished against the commission and wardens in their official capacities. The case remains against the wardens individually and trial is expected soon. The defense argued the state could not be sued without legislative permission and wardens could not be sued in official capacity. A final hearing date will be set shortly. Kettells may be called for a final physical and could be drafted soon.
