Omaha January 9 United States Circuit Court ruled Senator Charles H Dietrich was not a senator at the time of the alleged acts and that under the court's construction no testimony could be introduced. District Attorney Summers entered a nolle in other cases and both Dietrich and Postmaster Fisher were discharged. The judge instructed the jury to find not guilty under the circumstances and noted the decision would preclude further prosecution. Two track walkers killed near Philadelphia on the outskirts of the city as they walked home from work along the tracks after being struck by a train.
James W Sweely publisher of the Williamsport Sun died of pneumonia. The Baltimore Society of the War of 1812 held a banquet celebrating Jacksons New Orleans victory. Charles Brooks, inmate at New Jersey state prison, dies by hanging in dungeon after attempting to escape. Deputy keeper William Harney and Centre Keeper John Fitzgerald injured during the assault with Fitzgerald expected to recover. Brooks was serving a 20 year burglary sentence from Hudson County.
An order from the state board of health closes about 75 schools in Green county townships Morris Centre Rich Hill and adjoining East and West Finley in Washington county due to a smallpox outbreak. The epidemic began weeks ago in Time village, with most families affected and quarantines in place.
