Judge Stanley Bennett said the state failed to prove he knew of a Montgomery County circuit order giving custody to his wife. The speaker testified he did not attend the hearing and did not know the order existed. The case included claims the father carried the child from the home amid protests by the mother-in-law Ruth Davis of Clarksburg.
