Maryland Court Denies Contributory Negligence Claim in Dog Bite Case
In Baltimore City Court Judge Dennis ruled Miss Nullie M Hutching not guilty of contributory negligence after attempting to pat a dog at Weary O Boetzler's drugstore on November 19 1901. Hutching won $376 damages for a dog bite, with the judge criticizing the defense prayer to direct a verdict in favor. The decision held the store environment a quasi public space where a dog may bite from friendly actions, and that contributory negligence could not be claimed when the dog acts in response to a polite pat.
