ABM Hotel DWT Reach Jury In Lightfoot Suit
May D Lightfoot loses a $6000 damages case against David Lowenstein and Char W Wertheimer owners of the City Hotel lessee. The Montgomery county court did not send the case to a jury, sustaining defense demurrer that the hotel step was not negligent. Evidence showed Lightfoot tripped over a room hallway step on August 8 1912 after rooms were rearranged in the City Hotel. Attorneys for both sides argued over negligence standards with the judge ruling the plaintiff could not recover. The matter traced origins to a dispute over room elevations and building remodelling practices.
