Roosevelt Men Defeated In Two State Primaries
In California and South Carolina Democratic primaries, Roosevelt backed candidates fared poorly. Ellison D. Smith won renomination in South Carolina over Gov. Johnston, while Sheridan Downey led McAdoo in California by about 153,000 to 119,000 votes as 6,211 of 12,438 precincts reported. Downey campaigned on a pension plan opposed by McAdoo and some White House aides predicted Smith’s victory.

State License Bureau Refuses Beer License in Woodsboro
Frederick County officials uphold a decision to deny Edward W. Miss and partner Bessie Smith a Class B on sale beer license for Woodsboro. The state bureau ruling cites a false statement in a prior application showing Miss's partnership with Baxter Smith, applying strict statutory grounds. The August 29 1938 memorandum notes the entire license application must be refused due to the partner disqualification and reaffirms there is no discretionary leeway in this case. Further opinion on Clarence A Ebberts's appeal remains pending.
