President Roosevelt refused to commute John W. Burley’s death sentence for criminal assault on a young girl. The president directed the August 26 execution proceed, rejecting insanity defenses and warning that swift, certain justice combats lynching. Also reports a schooner collision near Cape Cod ending in four deaths and a strong New Zealand earthquake with damage but no fatalities.
Reports from Chefoo and Port Arthur depict heavy gunfire near Port Arthur with rumors of a fortress fall denied. Marquis Oyama plans to attack Liao Yang on August 20 as Japanese naval actions and Russian defenses near Port Arthur continue to unfold.
Vandalia train No 2 from St Louis running 60 mph struck a broken rail near Plainfield depot. Five cars overturned and a gas storage tank ignition caused fire. No deaths. one serious injury to Mrs E Widgerson of Antigo Wisconsin. most injuries from shattered glass.
Lieutenant General Baron Keller, a noted 61st army officer, was killed by a Japanese shell. A veteran of the Russo Turkish war, Keller was chosen to succeed General Zassoulitch after the Japanese routed him at the Yata river. He was a favorite of the czar and a prized fighting man for General Kuropathin.
Secretary Hay bluntly told Turkish minister Chekih Bey that American patience is nearly exhausted. Bey doubted reports of American warships. Hay confirmed the naval demonstration and urged a prompt settlement of American demands in Turkey as the Porte and Ismetan issue a swift reply. The Sultan is perturbed as Smyrna squadron moves and Washington seeks final acknowledgment.

Police mounted a large search as Philadelphia and Montgomery County avenues were alerted. two suspects were briefly held then released.
Pueblo Colorado August 92. Wreck of the World's Fair River on the Denver and Rio Grande near Eden seven miles north of Pueblo. Two crowded passenger cars and a baggage car engulfed in a torrent that tore out a trestle. Only three occupants escaped. Seven bodies recovered by morning with many more feared. Corpses found along Fountain river. bridge failure caused a 30 foot plunge into the arroyo. Local morgues filled as search continues.
Lincoln Aug 9 Thomas H Tibbles Populist vice presidential candidate says Democrats in Nebraska will get three state ticket nominees anti Parker to win fusion support. He asserts Democrats must back Watson and Tibbles or lose the Populists, who will boycott the fusion convention if the plan fails.
Dominic Conviance, an Italian member of a five man jailbreak gang, was recaptured on Bald Eagle mountain near his former Bellefonte hideout, ending his time at large while only one gang member, George Livingstone, remains at large.
