Day Given Two Years In Prison For Jail Escape

Norman L. Day a 25 year old Gaithersburg man was sentenced to two years total in the House of Correction by Associate Judge Patrick M Schnauffer in Circuit Court this morning on charges of false pretense and escape. Day received 18 months for four false pretense counts and six months for escape from jail to run concurrently. He testified naming Nick Koprivich of Weirton West Virginia as the man who engineered the jail break nine days ago. Koprivich was arrested next day in Montgomery County and sent to the penitentiary for a four year term for robbing the Moose Club here. Day claimed Koprivich had sawed a window bar with a hacksaw blade and that Koprivich told him he was going out. He admitted passing four checks for 25 dollars each at Henrys Penneys P L Hargett and Marlows Liquors, all drawn on a Montgomery County bank and marked no account. State's Attorney Price noted three other checks had no information. He said Day had two prior assault and battery convictions and a suspended false pretense sentence in Montgomery County. Detective Dietz reported Day was also on bond in Montgomery County for forgery. Sheriff Alexander cited the escape occurred between 1 and 7 a.m. on April 3, when escapees dropped from a second floor window and removed a lock on an outside gate. Judge Schnauffer observed Day had prior opportunities, including a suspended sentence, and that Day left the jail though other prisoners stayed. Day, married but separated from his wife, declined counsel.
