Prosecution For Sedition Is Limited
The Supreme Court ruled a state cannot prosecute acts of sedition against the federal government. It overturned the Pennsylvania conviction of Steve Nelson, a Communist party leader, who had drawn 20 years in state court and five years under the Smith Act in federal court. The court split 6 to 3 upholding the state decision that federal law preempts state sedition statutes.
