The jury found no maladminstration or bias in the two trials of Melvin W. Smith and concluded officers did not use excessive force while escorting him to jail. The Post editorial had criticized lopsided justice and noted 21 witnesses testified in the two cases.
A Montgomery County grand jury indicted the Washington Post Co on two counts of criminal libel over a Jan 13 editorial criticising Judge John B. Diamond II and Asst. State's Attorney Harper M. Smith. The actions stem from Jan 11 trials involving Melvin W. Smith of Gaithersburg who was convicted for a Dec 17 assault on a county detective. Sergeant Frank Griggs was the detective.
