Higher Court Reverses Secretary Lane in Indemnity Suit
A District of Columbia Court of Appeals ruling on April 3 holds the Central Pacific Railway Company retains a contractual right to its indemnity selection made under the 1866 Act, despite later withdrawals by the government under the 1910 power site law. The decision says the executive withdrawal cannot nullify the grant and directs relief for the company, a point echoed amid New Mexico disputes over state indemnity selections.
