Trolley Co Wins in Supreme Court
Youngstown Ohio March 16 Two important suits were won in the state supreme court Tuesday by the Mahoning Valley Street Railway Company at Columbus when the high tribunal in Ohio decided against the plaintiffs in the cases of Hugh Jones vs the company and Marietta Stiles against the Ingersoll Amusement Company which runs a roller coaster at Idora Park owned by the traction corporation. The Jones case has been in courts about eight years. Hugh Jones, the plaintiff, was a court clerk for Mercer county Pennsylvania and his home is in Sharon. About eight years ago he was run down by a street car on Hast Federal street, Bear Basin, and his back was broken. He was sent to the city hospital there for several months and recovered sufficiently to move about with a neck brace. He sued the company for damages and received verdicts in various trials, all of which were reversed and remanded until the third suit resulted in a decision for the defendant. The case was appealed and the supreme court has affirmed the judgment of the circuit court. Marietta Stiles received a verdict against the defendant company and the case was appealed to circuit court, which also held for the plaintiff. The supreme court reverses the lower courts in favor of the defendant. The plaintiff was injured while riding in a roller coaster at Idora Park. The defense held the company was not liable and the supreme court has decided the point was well taken.
