Court overturns Clerk ruling in Floyd County schools fight

The Indiana Supreme Court reversed a lower court ruling in the Floyd County superintendent of schools dispute between Roy L White and Levi H Scott. White, aided by attorney G H Hester, gains a favorable decision and the case will proceed to final resolution with about 2500 dollars tied up in the ongoing litigation. The controversy traces to a 1907 election when trustee votes and eligibility questions led to a protracted legal fight. The court notes trustees must elect a superintendent when lawful times pass and discusses White residence questions and earlier elections in detail. A new trial is ordered, delaying final victory for White, but affirming substantial points in his favor.
