Demurrer Advances in Muscatine City V County Case

The city of Muscatine files another demurrer to the defendant’s amended answer in the Muscatine city versus Muscatine county case. The judge will hear the argument in a few days, with a likely sustainment. The ruling yesterday shielded the old water works company from the case, and Kemble’s counterclaim was eliminated. If the demurrer holds, it reaffirms that back taxes on the water works plant are not the city’s, leaving the county to absorb the loss of a little over $800, a matter that could go to the state supreme court.
