Sanitary sewer project case in Muscatine County court
Gilbert D Jacobs owner of a Vacant Colony lot seeks to enjoin the city and block a 1074 tax assessment in a suit filed on the eve of bids opening. The city council plans to open bids to build a 1720000 project costing about 130000 and raise total expenses to 172000. Jacobs argues improper preliminary procedures and uneven assessment citing Colony drive parcel limits and front footage based valuations. The case raises a legal question over the special benefit basis for real estate assessments in sewer improvements.
