Fire Marshal Authority Reined In on Warrant Needs

Circuit Judge Chraver Watson ruled that the state fire marshal and deputies must have search warrants to enter buildings for fire investigations. The decision came in the cases of William LaBeau and Miss Helen Trusner, both of Decatur, linked to a 1952 arson and a fire and explosion that destroyed LaBeau’s building. Evidence cited by assistant fire marshal James Wyse was alleged to be obtained without a warrant and was challenged. The ruling grants tighter procedural protections in search actions.
