Clerk Warns on Probate Rules for Post 1953 Documents
Mrs. Martha O Comer, Clerk of Superior Court in Surry County, told local lawyers and the public that the county clerk’s office will not accept for probate or recording any documents executed after July 1, 1953 unless the words Drawn by and the draftsman’s signature appear on the charge. She noted checks in Mount Airy were drawn on an Asheboro bank and two in Surry County, with the draftsman clearly designated on the cover page. The rule does not bar holographic wills, which must be entirely in the deceased’s handwriting and found among valuable papers. The clerk cited the state law requiring the office to judge the sufficiency of acknowledgments.
