Charles Herring and Mayor Carole McClellan announced a protest against Montana's coal severance tax filed by Decker Coal Co. The challenge seeks to force a court ruling on constitutionality, risking over 400 million in extra fuel costs to LCRA and Austin electric customers, with suit to be filed within sixty days and final decision by the U.S. Supreme Court.
