Supreme Court limits death penalty jury selection
The Supreme Court ruled 5 to 4 that a death sentence cannot be imposed by a jury from which persons with conscientious or religious scruples against capital punishment are automatically excluded. The decision in an Illinois case reverses William C. Witherspoon's death sentence, saying the jury’s exclusion of 39 veniremen distorted the community’s conscience on life or death. Justice Stewart stated the ruling does not create a per se rule and notes the record is too tentative to prove a substantial increase in conviction odds. Justice Douglas dissented.

Lockport Teacher Wins Final Battle
The Supreme Court ruled 8 to 1 that a teacher may not be fired for speaking out on public issues without proof of knowingly or recklessly false statements. Marvin Pickering, a Lockport high school science teacher, had been dismissed after a 1964 letter criticizing tax funded athletics. Justice Marshall said the state may regulate employer speech differently, and Pickering’s comments did not impede teaching or school operations. Justice White issued a partially concurring view.
