Judge Thompson in Harrisonburg ruled that a defeated primary candidate may win in the general election if more voters back him, citing constitutional right to vote for anyone. The decision, supported by B F Russell and Dr W P Robinson’s dispute, keeps Russell in office and sets the stage for appeals to the Court of Appeals and possibly the Supreme Court.
The count showed Mr. Russell received more votes than Dr. Robinson, and voters held the right to write in his name on ballots. The judge said the decision would not affect politics locally due to the large urban electorate.

Aberdeen Mississippi April 2 Mrs Catherine Carter repudiates her husband’s testimony in the murder trial of John Carter who killed Dr Wendell She denies improper relations with the dead man and declines to speak until assured the statement will not reach the jury The defense rests after Carter’s dramatic account of finding the physician with his wife and the ensuing confrontation that led to the shooting.
In the Senate today prominent speakers paid tribute to Francis H Pierpont the father of West Virginia as the chamber accepted the marble effigy donated by West Virginia for Statuary Hall. Pierpont helped unite western Virginia and led troops under Lincoln to preserve the Union during the Civil War.

Washington April 2 A new cotton anti option bill similar to the Scott measure is under consideration in the House. It would not affect grain exchanges as subcommittee members say West sentiment favors keeping grain futures. No final action was taken yet but a bill may be ready by Sunday. The full committee meets mid next week. An immunity provision mirrors the Bik ing act requiring testimony without prosecution immunity.
The minister denies knowing a trap was set to ensnare a bribe giver, asserting no involvement or awareness of any such plot. The remarks come amid inquiries into alleged misconduct and political pressure.

In Indianapolis on April 2, negotiations between bituminous coal operators and miners intensified as they seek a new two year deal. Miners insist on no less than five cents per ton increase, aiming to end work stoppages and restart mining.
