He cited a spate of criticism and a nonconstructive attitude and returned to London. The dispute centered on interim government powers and a cabinet responsible to the people, with Hindu majority fears and Moslem League concerns shaping the outcome. Abul Kalan Azad urged postponing issues to unite India for defense.
A federal jury convicted Jesse Roy Thornton of Waverly in a four day trial for making a false statement on his selective service form. Judge Ben Dawkins deferred sentence until tomorrow. Thornton claimed ministry of Jehovahs Witnesses to gain exemption. Assistant U S Attorney John Patin defended the government. Joseph Guerriero led the defense. Thornton testified he is a minister and cited obedience to God over man-made laws when conflicts arise.
Lew Ayres is described as washed up with Metro-Goldwyn-Mayer after refusing to bear arms in defense of the United States. Nicholas Schenck, MGM president, said Ayres “washed himself up” with the public and has no further value as a screen star. Schenck cited hours of pleading but refused to defend conscientious objectors.

James A Noe and the Win or Lose corporation were found not guilty on all four counts of income tax evasion in federal court. The jury reached a 10:05 p m verdict after five and a half hours of deliberation as Noe, a former governor, embraced his wife and sobbed. The indictment charged evasion of income and excess profits taxes for 1935. Noe had planned a 1942 Senate bid but has not indicated any plans since acquittal.
Chinese crew members aboard a British merchantman in New York harbor mutinied, killing Ling Young Chai, 29, and injuring First Officer William R. Cherry. Eleven Chinese sailors were arrested as Captain Hilton Rowe confirmed the attack occurred after shore leave was denied.
