Coal Land Firms Cut Depletion Allowance Ruling
The Fourth U.S. Circuit Court of Appeals ruled that coal land leasing firms cannot claim the full 10 percent depletion allowance for income tax purposes. The decision, over the U. S. Tax Court, involved Jewell Ridge Coal Corp. and Paragon Coal Co. with oral agreements showing shared economic interest with mine operators. A firm spokesman warned the ruling could be serious for companies with similar contracts affecting half their producing mines. In Indianapolis Walter Louis Baran of Gary filed to run for the state legislature, while Sen. Walter Andrew Baran of Hammond and Sen. Walter Baran of East Chicago denied relatives or connections to Gary candidates.
