Supreme Court Rules Right of Publicity May Shield Acts
The Supreme Court ruled 5 4 that news media can be liable for damages if they broadcast an entertainer's entire act without consent. The decision allows states to grant publicity rights through law, or to shield media, with the majority noting states are not obliged to authorize suits. Hugo Zacchini, the "human cannonball," argued his act was publicized without permission after a 15 second broadcast by Scripps Howard Broadcasting Co. News coverage stopping short of obscuring the act was not contested.
