Court Limits On Death Penalty Supreme Court ruling
The Supreme Court upheld the death penalty in some cases but imposed new limits that could invalidate state laws. It ruled 5 to 4 that capital punishment laws must have standards and a method to consider the offense. It struck down mandatory death penalties in Louisiana and North Carolina while upholding Florida, Georgia, and Texas schemes. The decision stresses jury discretion and consideration of both aggravating and mitigating factors, with many states likely to test laws in coming cases.
