Maps constables Robert Angstadt 41 David Hrycyk 42 and Marc Seiller 30 were arrested and charged on july 3, 2013 in connection with the arrest of James Halcro 37. The Trio were alleged to have assaulted Halcro during the Early morning hours of aug. 25, 2012 at the Cecil hotel bar after confronting the Man following a 911 Call of a woman being hit by a male. At trial the Crown alleged police actions were Over the top during the arrest of Halcro which saw the Man taken to the ground by Angstadt by the neck and repeatedly struck. The defence refuted the allegations with the officers testifying they were following their training in subduing a highly resistive suspect who was believed to be involved in an assault while in an especially hostile environment. Evidence Given at the trial failed to substantiate any assault taking place or if Halcro was in fact told he was under arrest prior to being taken to the ground by Angstadt and hit numerous times. The strikes included an undefended knee by Angstadt to the face while the Halcro was on his Knees and Hrycyk was holding one of his arms. The Crown alleges the third Constable to arrive Seiller also struck Halcro As the two initially responding officers struggled with the Man who the officers testified was displaying incredible strength. The Crown did not argue whether the initial responding officers had grounds to detain Halcro but stated the use to do so was excessive. Halcro was taken to Hospital by City police from their holding cells at the Medicine hat remand Centre after being held in custody for a few hours during the morning of aug. 25, 2012. The Man was admitted to Hospital that morning and subsequently released. Halcro later returned to the Hospital in the evening was admitted and eventually diagnosed with a torn bladder that was treated through surgery a number of Days later. Defence counsel for the accused argued there is reasonable doubt As to How Halcro received the torn bladder and also highlighted the time gaps Between the original Hospital visit subsequent admission and time it took to perform the surgery.
