Mathews County Liquor Law Prosecutions Clarified
The Supreme Court of Appeals ruled that prosecutions may be under either the general state law or the Mathews county special law for intoxicating liquor. The only difference is that the special law cites possession of a United States license as evidence of retail selling, while the general law treats it as prima facie evidence of sale. The burden lies on the defendant to prove no violation, aligning with due process.
