Manitoba Court Invalidates Section of Welfare Act
The Manitoba Court of Appeal struck down a cabinet approved rule under the Manitoba Social Allowance Act that counted a parent's financial resources in assessing aid for applicants. It said the regulation exceeded cabinet powers and was inconsistent with the act, limiting inclusion of parental assets to cases where parents aid the applicant directly, such as providing support that then becomes part of the applicant’s resources. The ruling came on a Winnipeg case involving a Brandon University student who was denied aid while pursuing schooling.
