Suit Filed In Andrews Over Bank Stock Tax

A 10th District Court suit challenges Andrews city tax on bank stock as illegal and unjust. John E. Smith of Commercial State Bank leads plaintiffs including bank board members against City of Andrews and officials including tax assessor Dorothy Byrd and Mayor L F Craft. The banks argue stock taxes hit only stockholders and violate state law, noting banks were taxed previously on real estate and fixtures. The suit follows a new evaluation program cited by the Fort Worth firm Andy Capers Co and a council move to tax bank capital surplus and undivided profits.
