Morals Case Appeal OKd for Jelke to Court of Appeals
New York prosecutors won permission to appeal to the Court of Appeals in Albany to overturn the Jelke morals conviction. The appellate division granted leave to Manhattan District Attorney Frank Hogan after voting 3 to 2 to reverse the verdict, citing questions of law. Jelke, a 24 year old leomargarine heir, was convicted as a procure society procurer and jailed three to six years but free on $50,000 bail pending appeal. The reversal stemmed from a public trial rights issue when the press and public were barred during prosecution presentation.
