School Tax Exemption Reinstated by California Supreme Court
The California Supreme Court, in a 4 to 3 ruling, upheld a 1951 law granting tax exemptions for property used exclusively for school purposes owned by religious, hospital, and charitable entities. Chief Justice Gibson wrote the majority opinion, upholding the interpretation that educational aims can be considered charitable under the state constitution. Alfred J. Lundberg had challenged the measure in Alameda County Superior Court, arguing it violated constitutional provisions. The vote reversed the Alameda ruling, restoring the tax exemption for qualifying institutions following a 1952 referendum outcome.
