Opinion Upholds Towns On State Paving Work
Attorney General Gilliam states the state highway commission cannot pave excess width connecting streets in towns under 2500 population without town consent. The town must pay costs of excess width, with required procedure to bind the municipality. City officials cannot assess all extra costs to abutting property or contract with the state for such work.
