Clearwater County Creation Held Void by Idaho Supreme Court
The Idaho Supreme Court ruled unanimously that the 1901 act to create Clearwater County did not establish a county. The court held the legislature failed to state the county “shall constitute” Clearwater, leaving the county unestablished and voiding the writ of mandamus for licenses. The decision emphasizes that courts cannot create a county by implication or interpolation.
