Perkins county held law question headed for fall vote
The action against County Auditor E F Barrett of Perkins county sought to bar submitting the 1907 South Dakota Chapter 244 law to voters at the November general election. A petition with 1250 signers supported submission while 250 ranchers urged against it. Plaintiffs included John Kelley and others. Judge Frank McNulty sustained the demurrer and dismissed the case with costs, setting the question to be decided by voters in the fall election.
