Court limits guidelines ruling in Kansas sentencing case
The Kansas Court of Appeals narrowed a June Supreme Court ruling on sentencing by stating that a prisoner who pleads guilty and avoids a jury does not require a jury for sentencing. Barry Cody, convicted on drug charges in 1999, received over five years though the offense typically carries 2.5 to 3 years. Cody will appeal to the Kansas Supreme Court as other cases await clarification of the ruling’s impact.
