Kansas youth’s flag drawing suspends over harassment policy
The Supreme Court rejected a Derby Kansas case over a seventh grader TJ West suspended for drawing a 4 by 6 inch Confederate flag in class. The Rutherford Institute filed suit claiming First Amendment rights were violated, but lower courts upheld the district policy banning racially divisive material. Derby officials defended the policy as necessary after 1995 tensions linked to Confederate symbolism. West had prior discipline for using a slur, and the 10th Circuit noted the harassment rule in enforcing the suspension.
