Kansas Supreme Court orders resentencing in two murder cases

The Kansas Supreme Court vacated the 2008 murder sentences of DeAnda in Finney County and Astorga in Leavenworth after ruling that a judge rather than a jury imposed the sentences. The decision follows the U.S. Supreme Court’s 2013 ruling and comes amid Kansas’ Hard 50 reform, which lawmakers enacted to require juries for life without parole minimums. The court did not determine constitutionality of the revision, noting the issue was not ripe for review.
