Fourth Amendment cited in DUI case overturns garage entry
Kansas Court of Appeals ruled officer Laurie Scott violated the Fourth Amendment by placing a foot under a closing garage door to confront Troy E. Dugan in 2009, instead of obtaining a warrant. The panel ordered suppression of the evidence, sending the case back for further proceedings. Douglas County DA Branson said prosecutors are reviewing the opinion and considering an appeal.
