Kansas Supreme Court limits warrantless vehicle searches in open container cases
The Kansas Supreme Court reversed a Sedgwick County methamphetamine conviction, ruling that the smell of alcohol inside a stopped SUV does not justify a warrantless interior search. Officers lacked probable cause to search beyond inspecting for open containers, leading to illegal seizure of drug paraphernalia and methamphetamine. The case sent back for a new trial without that evidence. Prosecutor Marc Bennett said retrial timing is uncertain.
