A new injunction suit was filed this afternoon by attorney C A Smart for J J Simmonds against Fred Otto Mayn Mayor R C Rankin and Commissioners Constant and Wetzel. It seeks nullification of the original Lawrence zoning ordinance of August 8 1927 and the amended rezoning at Thirteenth and Massachusetts Street. The petition also seeks a permanent injunction against building in the U S business class at the disputed corner due to dangerous traffic and potential depreciation of nearby property values. It asserts the original act and the recent amendment are invalid and claims more than twenty percent of nearby property owners opposed the rezoning prior to the new ordinance.
