Dual election system questioned in Kobach case and ACLU suit

The ACLU argues a constitutional issue could allow a bifurcated election system. In 2014 Kansas used a dual system where federal form voters could only vote in federal races, delaying action as courts weighed the matter. If Theis rules against dual elections, the proof of citizenship requirement could be challenged. Kobach maintains the federal form applies only to federal elections and is not binding on state races.
