Professor wins round in FBI Lennon files fight

The 9th Circuit had ordered fuller explanations, but did not force immediate disclosure. The Supreme Court refused to hear argument on the FBI appeal, keeping the lower ruling intact.

Supreme Court restricts federal reviews of death sentences
The Supreme Court unanimously upheld Robert Wayne Sawyer's death sentence and set a new standard for federal judges evaluating successive appeals by state inmates. The Court embraced the 5th and 11th circuits’ 'actual innocence' standard, limiting hearings, while Justices Stevens Blackmun and O'Connor favored a stricter rule that a defendant is probably innocent. Sawyer killed Frances Atwood in Gretna on September 29, 1879.
