Dissent by Justice Dawson on Chancellor removal case
Justice Dawson dissents from the majority ruling noting the governor and Board actions raise malice and coercion concerns. He argues the court must intervene where arbitrary power or abuse of administrative discretion is shown, preserving due process and judicial review in state governance. He cites multiple Kansas cases to support that non judicial power requires reasonableness and limits, and questions the adequacy of the majority’s stance on corruption versus malice.
