Supreme Court orders refunds of impounded processing taxes
Washington January 15. The Supreme Court ruled that $200 million in impounded processing taxes must be returned to processors as they were invalid under AAA. It left undecided whether $1 billion already paid to farmers could be retrieved. The decision noted the revised act did not cure the original act’s infirmities and that refunds depend on litigation in lower courts. The court also dismissed the first Bankhead cotton act test case, with related cases to follow.
