Nebraska judge tosses illegal immigrant tuition case
Jefferson County District Judge Paul Korslund dismissed a lawsuit filed by six Nebraskans challenging the state in-state tuition law for certain undocumented students. The suit argued tax funds were used in violation of federal law and directed that the plaintiffs may refile in state court after federal action or inaction. The 2005 law lets students who grew up in Nebraska, finished high school there and meet residency rules pay in-state rates, which are substantially lower than out-of-state fees. The plaintiffs' attorney Kris Kobach indicated possible appeals or seeking federal intervention, noting the case is far from over.
