Appeals court denies AG's bid for full same sex marriage review
A federal appeals court in Denver denied Kansas Attorney General Derek Schmidt's request for en banc review of a lower court ruling allowing same sex marriages to proceed in Douglas and Sedgwick counties. The ruling means marriages may continue for now while the case proceeds, with further appeals moving through a three judge panel. The ACLU suit originally challenged clerks denying licenses to two lesbian couples and has since added a claim over Kansas recognizing out of state marriages. The AG plans to keep fighting pending Supreme Court guidance on the constitutionality of Kansas' same sex marriage ban.
