Environmental groups lose Missouri River appeal

The 8th U.S. Circuit Court of Appeals upheld a district court ruling favoring the Army Corps of Engineers and its plan to keep summer river levels high for barge shipping. Environmental groups and regional interests argued for more natural ebb and flow to protect endangered species, but the court said flood control and navigation justify the plan. Nebraska Attorney General Jon Bruning welcomed the decision, noting ESA obligations do not trump congressionally authorized river purposes. The case involved American Rivers, Environmental Defense Fund, Izaak Walton League, and others across multiple states and tribes.
